TERMS & CONDITIONS for NYE on the Hill 2019/20
All purchasers of tickets to the NYE on the Hill 2019/20 must be aware of the below listed terms and conditions of sale:
Tickets to the NYE on the Hill are sold by The Hills Are Alive Group Pty Ltd, ABN 97 151 690 343. Purchase of tickets to this event constitute a contract between The Hills Are Alive Group Pty Ltd, the purchaser and, in the event that the ticket is purchased on another’s behalf, the ticketholder. Tickets are sold subject to the following terms and conditions which form part of the contract between The Hills Are Alive Group Pty Ltd, the purchaser and the ticketholder.
NYE on the Hill (the Event) is presented by The Hills Are Alive Group Pty Ltd trading as NYE on the Hill ("Us, Our, We, the Presenter, Management"). By purchasing a ticket to NYE on the Hill and entering the event, you acknowledge and agree to the below Terms and Conditions of Sale and Entry.
NOTE: For the purposes of these terms & conditions the venue may be referred to as 'The Farm' or 'The Hill', NYE on the Hill referred to as 'The Event' and the ticket/s referred to as 'wristband', 'digital ticket' or 'printed ticket'.
VALID PHOTO ID IS REQUIRED FOR ENTRY FOR ALL PATRONS.
All patrons attending NYE on the Hill MUST be over 18 years of age. Patrons must present a legal form of valid photo identification at the event entry or to access licensed areas, such as a current Australian driver's license (international driver's licenses won't be accepted), State Approved 'Proof Of Age' card or a valid Passport.
If you are a parent/adult legal guardian and you are wishing to bring a child in your care to the event, please contact the event to request a FAMILY REGISTRATION FORM.
Please be aware that 'Digital Ticket', 'Printed Ticket' and 'Wristband' are interchangeable terms used for a NYE on the Hill/The Hills Are Alive ticket. Festival wristbands must be worn at all times around the wrist of the Festival ticket holder once the digital or printed ticket has been exchanged for a wristband. Your wristband gains you entry in and out of the festival site while gates are open. Any person found not to be wearing an official event wristband or accreditation pass will be deemed to be trespassing and be evicted from the event. Do not share your ticket barcode or event wristband with anyone else or you may be denied entry. The Hills Are Alive Group Pty Ltd reserves the right to deny admission to the bearer of any ticket or wristband that appears to have been tampered or has been previously presented. Anyone entering the site without a valid wristband will be deemed to have trespassed and will be handed over to the Police for charging. Maximum penalties apply.
Wristbands must be worn around the wrist of the holder for the duration of the Festival. Once the holder has arrived at the Festival, the holder’s wristband cannot then be shared or transferred to anyone else. All visitors are required to stop and show their wristband when requested by authorised staff. Once a wristband is removed it becomes void. For security purposes wristbands remain the property of The Hills Are Alive Group Pty Ltd at all times until the advertised gates closing time of the Festival.
Some of the artists appearing may use lyrics, language, gestures or symbols whilst performing that some people may find offensive. If such language or behaviour may concern the holder, or a minor accompanying the holder, they should either not attend, or leave the vicinity. Some participants may engage in expressive activity and dress, which may include partial nudity or nudity; please avoid the HILL during this time if such activity may concern the holder.
NAMES ON TICKETS
All THAA group events require correct credentials on tickets sold through our official ticketing partner Eventbrite in conjunction with our official resale partner TIXEL in order for us to avoid ticket fraud, and run a safe event by knowing exactly who we have on our event sites at all times in case of an emergency. See above for how to ensure the name on the ticket is correct.
The Hills Are Alive Group (Event Management) reserves the right to refuse admission and in such an event will not refund any admission fee paid. In the event of a lost, stolen or damaged ticket/s or where the ticket holder cannot attend the event due to reasons beyond the Management's control no refunds will be issued. If for any reason the event date/time and/or venue is changed ticket holders will be notified of the change and all tickets will remain valid. Event Management reserves the right to alter advertised playing times and substitute artist if required to do so. There will be no refunds for playing times or line-up changes. Event Management will use all reasonable endeavours to notify Patrons of the change, all tickets will remain valid and refunds will not be issued. A change in personal circumstances does not automatically entitle the return or exchange of an Event ticket however Event Management may consider such a return at its own discretion.
Event Management may at its own discretion refund Patrons if the Event is cancelled due to calamitous weather, an act of war or terrorism, or any event outside the control of The Hills Are Alive Group, collectively referred to as a Force Majeure event. In the instance of event cancellation, the event organisers will work with ticket holders to come to a fair and reasonable outcome. Tickets may not, without the prior consent of the Presenter, be resold or offered for resale at a premium over the face value of the ticket (including via online auction sites) or used for advertising, promoting or other commercial purposes (including competitions and trade promotions) or to promote the demand for other goods or services either by the original purchaser from the Presenter or any subsequent ticket holder.
PLEASE NOTE: Tixel is the only place you can safely buy a secondhand ticket.
** TICKETS PURCHASED THROUGH SECOND-HAND WEBSITES (such as VIAGOGO and TICKETMASTER RESALE) WILL NOT BE VALID ON THE DAY **
The only way to guarantee a resale ticket is valid is to purchase it through Tixel.
Please be very aware of forgeries, particularly if the event is sold out. We cannot stress this enough. If you arrive at the gate with a fake ticket – it will not pass the scanner and you will not be allowed entry. If the ticket you present is not valid you will NOT be allowed to enter the event. There will be no negotiations or exceptions made.
Upon entry to NYE on the Hill/The Hills Are Alive event patrons will be required to present their purchased ticket with a current matching legal form of identification such as a current Australian drivers licence, ‘Proof of Age’ card, or a valid passport in exchange for an event wristband specific to the year of the event. The Hills Are Alive Group Pty Ltd reserves the right to refuse a ticket holder admission to the event or to evict that person from the event. Entry is at the attending person's own risk. Appropriate footwear and clothing must be worn at all times on the site and earplugs should be worn if necessary. Entry to NYE on the Hill/The Hills Are Alive is only permitted to wristband holders and accredited staff who agree to have their vehicle and if required person searched on entry for glass, gas bottles and any other banned items. Refusal to consent to a search will prevent entry to the Event or eviction, without refund. The Hills Are Alive Group Pty Ltd takes no responsibility for any hearing damage or loss caused by excessive noise. Please note, Strobe lighting and flashing lights will be used during some of the performances.
Anyone entering the site without a valid wristband will be deemed to have trespassed and will be handed over to the Police for charging. Maximum penalties apply.
Patrons under the age of 18 can attend but must be accompanied by a parent/legal guardian AT ALL TIMES (older siblings or cousins are not acceptable guardians). The parent/legal guardian attending the festival acknowledges that they will remain within 2-3m of their minor at all times, or face eviction from the event without refund. Parents MUST stay within 2-3 metres of your child/ren at all times to avoid any risk of separation, and your child/ren being picked up unintentionally by security.
Anything that could cause harm is a prohibited item and will not be permitted entry to the venue. This includes but is not limited to glass, weapons, lasers, fireworks, flares, cooking devices, pets or animals and illicit drugs. Prohibited items that are confiscated will not be returned. The event site is a glass free zone. The event is run as a total fire ban; in no case are open flames allowed.
Professional/commercial Audio-visual recording equipment is NOT permitted to enter the event unless prior written consent has been has been granted by The Hills Are Alive Group Pty Ltd. Basic equipment in the form or mobile phones and portable cameras are permitted subject to the discretion of the event management. The Presenter reserves the right to remove a ticketholder if they are in breach of the requirements regarding audio visual equipment.
PARKING and travel
Patrons are encouraged to share transport. No parking is available offsite, a valid car pass MUST be presented to enter the event. Patrons must not leave vehicles alongside any public roads leading towards or near the venue. Vehicles identified to have been abandoned at the roadside by patrons or those seeking to trespass will be towed. Management accepts no liability for any action or omission by the parties involved in providing such transport.
Transport to and from the Farm will be operated by independent/private parties. Any claims including but not limited to accident, injury and damage resulting from transport should be directed to the third party. Holders agree NYE On The Hill is not liable for the consequences of any lengthy delays at any time including but not limited to entry to and departure from the Farm.
CONDUCT / EVICTION
You must ensure that you and your friends act in an orderly manner when attending the Event. The Hills Are Alive Group Pty Ltd may refuse entry or evict you or any of your friends if they are behaving in an intoxicated, disorderly, offensive, threatening or inappropriate manner, towards any person. Anyone found in possession, supplying or consuming illicit drugs will be evicted from the premises and reported to Police.
NO Crowd surfing, moshing, slam or circle dancing are permitted. These are all dangerous activities that can seriously injure other patrons and Management reserves the right to evict sweatband holders if they are involved in such activities.
Any breach of any of these terms and conditions will entitle the event organisers to evict the attending person from the private property without refund.
EMERGENCIES AND MEDICAL TREATMENT
In the case of an emergency evacuation, it is the responsibility of the ticket holder to follow all instructions and directives from the event management staff. In an emergency situation personal belongings may need to be left behind and Management does not take responsibility for, nor will replace or refund the cost of, or the items themselves.
In the event of injury or medical treatment requiring more than basic First Aid The Hills Are Alive Group Pty Ltd may, at the expense of the wristband holder arrange medical treatment and/or Emergency Evacuation as deemed necessary by the event First Aid team.
Entry is at the holder’s own risk. Without limiting the generality of this, appropriate footwear and clothing must be worn at all times whilst on-site and ear plugs should be worn if necessary. The hills are alive group Pty Ltd takes no responsibility for any hearing damage or loss caused by excessive noise. The hills are alive group takes no responsibility for damage or loss caused by theatrical effects like smoke or strobe lighting. Holders understand that theme camps and campsite parties are not owned or operated by the hills are alive group pty ltd The holder assumes all risk of injury or death arising from the operation of and/or participation in any of these activities.
By entering the event site you (the ticket holder) agree to being filmed or photographed, the product of which may be used for marketing or promotional purposes for perpetuity.

Without limiting the generality of this, appropriate footwear and clothing must be worn at all times on the site and ear plugs should be worn if necessary and The Hills Are Alive Group Pty Ltd takes no responsibility for any hearing damage or loss caused by excessive noise.
The Hills Are Alive Group Pty Ltd takes no responsibility for loss or damage to personal property.
To the fullest extent permitted by law, The Hills Are Alive Group Pty Ltd do not accept liability of any nature for the acts, omissions or default of those providing services in connection with the Event or any liability for any injury, damage, loss, delay or additional expenses which are incurred at or in association with NYE on the Hill/The Hills Are Alive events. Where legislation implies any condition or warranty which cannot be excluded or modified, that condition or warranty will be deemed to be included in this agreement. However, our liability for any breach of such condition or warranty will be limited, at our option, to the resupply of the services or the cost of having the services supplied again. In no event will we be liable for any indirect, consequential, exemplary or special damages.
To the full extent permitted by law, ticket holders waive all legal rights of action against and fully release The Hills Are Alive Group Pty Ltd, its agents, employees, members and volunteers for all claims for compensation for loss, damage, injury or death howsoever arising out of or in relation to the ticket holder's participation in the event including without limitation, liability for any negligent or tortious act or omission on the part of the persons released or under statute or for breach of these terms and conditions. Management shall not be held liable for any loss, injury or damages sustained entering, leaving or at the event.
WARNING: If you participate in these activities your rights to sue the supplier under the Fair Trading Act 1999 if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in or on this notice.
NOTE: The change to your rights, as set out in or on this notice, does not apply if your death or injury is due to gross negligence on the supplier’s part. “Gross negligence” is defined in the Fair Trading (Recreational Services) Regulations 2004.
It is a condition of purchase that the buyer consents to the Organiser retaining personal information as required by Privacy Amendment (Enhancing Privacy Protection) Act 2012(Cth). The Organiser will only hold your information for archive purposes and contacting you in relation to ticketing matters and The Hills Are Alive Group Pty Ltd event information. The Organiser will not trade, sell or otherwise dispose of your personal information.
